1. Nature of Service
Property Milan operates as a real estate consultancy and facilitation platform. We provide property information, site visit coordination, and transaction support between buyers, sellers, landlords, tenants, and developers. Property Milan acts solely as an intermediary and facilitator — we are not a party to the final transaction between the involved parties.
By accessing and using Property Milan's website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. You agree to use our services only for lawful purposes, in compliance with all applicable laws and regulations, and you shall not post false, misleading, or fraudulent information on the platform.
2. Property Verification
Property Milan provides almost verified property deals based on documents and information shared by the seller or owner. Our team undertakes reasonable efforts to verify listings through document review, KYC processes, and on-ground checks where applicable.
However, buyers are strictly advised and required to independently verify all legal documents, approvals, title deeds, permissions, encumbrances, and property status before finalizing any transaction. We reserve the right to reject, suspend, or remove listings that do not meet our verification standards. Any issue arising after the sale or possession shall not be the responsibility of Property Milan.
3. Accuracy of Information
All property-related details — including price, area, specifications, approvals, amenities, and availability — are provided by the seller, owner, or developer. Property Milan publishes this information in good faith based on what is shared with us.
Property Milan shall not be held liable for any incorrect, false, misleading, or incomplete information shared by the seller or developer. Buyers and tenants are encouraged to conduct their own due diligence and verify all details independently before making any commitment or payment.
4. Plot / Land Measurement Responsibility
The actual measurement, boundaries, area, and physical verification of any plot or land must be independently confirmed by the buyer at the time of the final deal. This should be done through a proper survey conducted by a licensed surveyor or competent government authority.
Property Milan shall not be responsible for any discrepancy in measurement, boundaries, or area discovered at any stage — whether before, during, or after the transaction. All measurement data displayed on the platform is indicative and based on information provided by the seller or developer.
5. Developer Projects & Possession Delay
In case of under-construction, newly launched, or newly developed properties, any delay in construction, possession, approvals, completion certificate, occupancy certificate, or handover shall be the sole responsibility of the respective developer or builder.
Property Milan shall not be liable for delays, financial losses, penalties, interest, or any other consequences arising from such delays. Buyers are advised to review the developer's track record, RERA registration, and project timelines independently before making a booking or investment.
6. Site Visit & Deal Conduct
All site visits are coordinated through Property Milan's authorised representatives. Clients are expected to schedule visits through our platform or team and conduct themselves professionally during property inspections.
Any direct dealing or transaction conducted without the knowledge or involvement of Property Milan — including but not limited to contacting the seller or developer directly after being introduced through our platform — shall absolve the firm from any responsibility, dispute, or claim arising thereafter. Such conduct may also constitute a breach of these terms.
7. Brokerage & Service Charges
Brokerage or service charges shall be applicable as communicated to the client prior to the deal. The exact fee structure, percentage, or flat rate will be disclosed transparently before any engagement or site visit.
Once the deal is confirmed — whether through agreement, token payment, or mutual consent — brokerage is non-refundable under any circumstances. Property Milan does not charge any hidden fees, and all applicable charges are communicated upfront. Failure to pay brokerage within the agreed timeline may result in legal action.
8. Documentation & Rent Agreement Support
Rent agreement and documentation assistance provided by Property Milan is a support service only. We help facilitate the drafting and preparation of documents for the convenience of our clients.
However, the final legal validity, compliance with local laws, stamp duty obligations, and registration of any such documents shall remain the sole responsibility of the client. Property Milan shall not be liable for any future legal disputes, claims, or complications related to documents prepared with our assistance.
9. Limitation of Liability
To the maximum extent permitted by law, Property Milan shall not be responsible or liable for:
• Post-sale or post-possession disputes between buyer and seller
• Market fluctuations, price changes, or depreciation in property value
• Financial loss or damage arising from any transaction
• Legal complications related to property title, ownership, or encumbrances
• Developer performance, project delays, or quality of construction
• Seller default, misrepresentation, or breach of commitment
• Government approvals, authority actions, policy changes, or regulatory orders
Property Milan acts solely as an intermediary and facilitator. Users acknowledge that all investment and transaction decisions are made at their own risk and discretion.
10. Jurisdiction & Legal Authority
All disputes arising from these Terms, or from the use of Property Milan's services, shall be subject to the exclusive jurisdiction of the local courts where Property Milan's registered office is located. These terms are governed by and construed in accordance with the laws of India.
Property Milan reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of our services after such changes constitutes acceptance of the updated Terms.
Legal Disclaimer
By engaging with Property Milan — whether through our website, application, office, or representatives — all parties acknowledge and agree that the firm does not provide any legal guarantees regarding property transactions. Property Milan shall not be held liable for any post-transaction outcomes, disputes, losses, or claims of any nature whatsoever.
